Decisions

To request approval to vary the contract for Domestic Gas Servicing and Repairs, and Communal Heating Systems Maintenance to permit the extension of the contract, and approval to extend the contract for a period of 12 months.

(1)      To approve the variation of the contract for Domestic & Communal Heating and Gas Services with Oakray Ltd.to permit the extension of the contract.

(2)      To approve the extension to the current contract as detailed in (1) above for a period of 12 months.

To request approval to vary the contract for Communal Electrical Works and Electrical Safety Maintenance to permit the extension of the contract, and approval to extend the contract for a period of 12 months.

(1)      To approve the variation of the contract for Communal Electrical Works & Electrical Safety Maintenance with Equans FM Limited (formerly Cofely Ltd. and Engie FM Limited) to permit the extension of the contract;

(2)      To approve the extension to the current contract as detailed in (1) above for a period of 12 months.

The decision seeks Cabinet Member approval to publish Sudbury Matters’ application for Neighbourhood Forum status. The application will be subject to a minimum six-week consultation. Following consideration of the representations received, the Council will need to determine whether to approve or refuse the application.

To approve the publication for consultation of Sudbury Matters’ application for Neighbourhood Forum Status.

Authority to tender for a care and support contract at the extra care scheme – Honey Pot Lane.

That the Cabinet Member for Public Health and Social Care, having consulted with the Leader in accordance with paragraph 13 of part 3 of the constitution:

i)             Approves inviting tenders for a new care and support contract at Honeypot Lane on the basis of the pre-tender considerations.

ii)            Approves officers evaluating tenders on the basis of the evaluation criteria.

To request approval for the Council to enter into a Developer Agreement, Lease Agreement and Lease in relation to the purchase of 294 homes at Fulton Road, Wembley

That the Corporate Director Finance and Resources, in consultation with the Cabinet Member for Finance, Resources and Reform:

i)             Approves entry into

a.    an agreement for leases with Crown Venture GP LLP and Crown Venture Nominee Limited

b.     a development funding agreement with Regal Homes Management Limited as the developer and Crown Venture GP LLP and Crown Venture Nominee Limited as Seller

for the purchase of a 999-year leasehold interest (less 3 days) in 294 homes (flats) located eon the former Euro Car Parks site, Fulton Road, Wembley, HA9 0TF.

ii)            Notes that under the contract referred to in (i) above, the payment terms agreed with the developer / seller are as follows:

·         22.5% payable upon delivery of ‘golden brick’ milestone for Block E - £21.55m

·         12.5% payable upon delivery of ‘golden brick’ milestone for Block D - £8.039m

·         65% to be payable via monthly valuations - £54.951m

To request authority to award a contract for a main contractor to undertake works in respect to the refurbishment of WC’s on Ground Floor at Brent Civic Centre.

That the Director Property and Assets:

i)             Approves the award of contract for refurbishment of WCs on Ground Floor at Brent Civic Centre for works to be completed over the period of six (6) weeks in the sum of £278,811 to Focus DGI Ltd, trading as Focus Washrooms.

This report concerns the contracts for the reprocessing of comingled recycling materials and household bulky waste collections. This report requests individual Cabinet Member approval to waive the requirement to tender for contracts and directly award them to West London Waste Authority (WLWA) pursuant to Regulations 12, Public Contracts Regulations, 2015 and in accordance with paragraph 13 of Part 3 of the Constitution. 

That the Cabinet Member for Environment, Infrastructure and Climate Action, having consulted with the Leader:

i)             Exercises delegated powers to grant an exemption from the usual Contract Standing Orders requirement to tender High Value and Medium Value Contracts in respect of:

a.    A contract for Reprocessing Comingled Recycling Materials

b.    A contract for Household Bulky Waste Collections (non-key)

ii)            Confirms there are good operational and / or financial reasons for granting the exemptions referred to in recommendation (i).

iii)           Approves award of contract for Reprocessing Comingled Recycling Materials Services to West London Waste Authority (WLWA) for a term of two years in the estimated sum of £2.773m.

iv)           Approves the award of contract for Household Bulky Waste Collections Services to West London Waste Authority (WLWA) for a term of two years with an option to extend by a further year in the estimated sum of £297k (the award of contract for Household Bulky Waste Collection is a non-key Cabinet member decision and therefore will not be subject to call-in).

In thanking members and colleagues for their support during her tenure as a Cabinet Member, Councillor Southwood formally announced her decision to resign as a member of the Cabinet.

In noting that Councillor Southwood would continue to serve as a member of the Council, Cabinet Members expressed their gratitude to Councillor Southwood for her dedication to Brent during her time as a Cabinet Member and praised her efforts in supporting the work undertaken to improve life for Brent’s residents.

Peter Gadsdon and Phil Porter declared personal interests in relation to Agenda Item 7 (i4B Business Plan 2023/24) and Agenda Item 8 (First Wave Housing Business Plan 2023/24) as Council appointed Directors on the Boards of i4B and FWH Ltd.

Councillor Grahl declared a personal interest in relation to Agenda Item 10 (Contract for Leaseholder Property Insurance) as a leaseholder in the borough.

Continuing with the Business Rates Discount for accredited LLW employers introducing a wider package of incentives.

Cabinet RESOLVED:

(1)                    To agree to renew the business rates discount for Living Wage Accredited Employers for a further three years and approve the policy as set out in Appendix A of the report.

(2)                    To note the proposed dialogue with a broader range of businesses, bearing in mind the nature of Brent’s businesses base as set out in paragraphs 3.1 to 3.14 of the report. The Good Work Standard Group, which represented Brent’s diversity of businesses, would inform and drive the campaign to enable credible business to business communication.

(3)                    To note the proposed targeted communications campaign; the Council’s offer of support to small and micro business, as set out in paragraph 3.27 of the report; and the Council’s offer of priority spaces to businesses committed to joining Brent’s Good Work Standard Business Management/Network. The suite of incentives would be endorsed by the Good Work Standard Group and could be piloted through the network and the Council’s weekly newsletter, which currently reached over 13,500 businesses.

Cabinet RESOLVED to note the performance information contained in the performance report.

This decision seeks authority to tender and delegated authority for award of the final contract for general insurance services.

Cabinet RESOLVED:

(1)                    To approve inviting tenders for Insurance Services on the basis of the pre-tender considerations set out in paragraph 3.4 of the report.

(2)                    To approve officers evaluating the tenders referred to in (1) above on the basis of the evaluation criteria set out in paragraph 3.4(vi) of the report.

(3)                    To delegate authority to the Corporate Director of Finance & Resources, in consultation with the Cabinet Member for Finance, Resources & Reform, to award the contract for Insurance Services for a term of three years with the option to extend for a further two years.

This decision seeks authority to tender and delegated authority for award of final contract for leasehold property insurance.

Cabinet RESOLVED:

(1)                    To approve inviting tenders for Leasehold Property Insurance on the basis of the pre-tender considerations set out in paragraph 3.5 of the report.

(2)                    To note that the Council would undertake consultation with leaseholders and Recognised Tenants Associations pursuant to Section 20 of the Landlord and Tenant Act 1985 (as amended), as set out in paragraphs 7.1 to 7.7 of the report.

(3)                    To approve officers evaluating the tenders referred to in (1) above on the basis of the evaluation criteria set out in paragraph 3.5(vi) of the report.

(4)                    To delegate authority to the Corporate Director of Resident Services, in consultation with the Cabinet Member for Housing, Homelessness & Renters Security, to award the contract for Leasehold Property Insurance for a term of three years with the option to extend for a further two years.

To approve discretionary schemes under section 47 of the Local Government Finance Act 1988 in accordance with government guidance.

Cabinet RESOLVED:

(1)                    To approve the Council’s National Non Domestic Rates (NNDR) Discretionary Scheme in relation to 2023/24 Retail, Hospitality and Leisure Relief as set out in Appendix 1 of the report and pursuant to the Council’s powers under Section 47 of the Local Government Finance Act 1988 as amended.

(2)                    To approve the Council’s National Non Domestic Rates (NNDR) Discretionary Scheme in relation to 2023 Supporting Small Businesses Relief scheme as set out in Appendix 2 of the report and pursuant to the Council’s powers under Section 47 of the Local Government Finance Act 1988 as amended.

(3)                    To delegate authority to the Corporate Director of Resident Services, in consultation with the Corporate Director of Finance & Resources, to implement the discretionary schemes set out in Appendix 1 and Appendix 2 of the report.

To approve the 2023-24 FWH Business Plan.

Having noted the introductory comments from Martin Smith (as Chair of First Wave Housing (FWH) Ltd Board) relating to the current performance and strategic priorities of FWH, Cabinet RESOLVED:

(1)                    To approve the FWH 2023/24 Business Plan.

(2)                    To approve the content and proposed strategic priorities of the FWH 2023/24 Business Plan.

(3)                    To approve the updated financial model contained within the FWH 2023/24 Business Plan.

(4)                    To approve the Service Level Agreement for 2023-25 in Appendix 4 of the report.

(5)                    To delegate authority to the Corporate Director of Finance & Resources to approve the variation of the Service Level Agreement during 2023/24.

To approve the 2023-24 i4B Business Plan

Having noted the introductory comments by Martin Smith (as Chair of the i4B Ltd Board) relating to the current performance and strategic priorities of i4B, Cabinet RESOLVED:

(1)                    To approve the i4B 2023/24 Business Plan.

(2)                    To approve the content and proposed strategic priorities of i4B’s 2023/24 Business Plan.

(3)                    To approve the updated financial model contained within the i4B 2023/24 Business Plan.

(4)                    To approve the Service Level Agreement for 2023-25 in Appendix 4 of the report.

(5)                    To delegate authority to the Corporate Director of Finance & Resources to approve the variation of the Service Level Agreement during 2023/24.

To seek approval for the variation of the existing contract and an extension, and approve inviting tenders for technical consultancy to manage the preparation and specification for the procurement of the new contract.

In addition, to delegate authority to approve the pre-tender considerations, evaluation, and award the contract for electrical and mechanical services works to the Corporate Director Resident Services, in consultation with the Lead Member for Housing, Homelessness and Renters Security.

Cabinet RESOLVED:

(1)                    To note the Mechanical & Electrical Services works (M&E) Contracts detailed in the table of paragraph 3.6 of the report were coming to an end but would be extended. The Council was aiming to procure the new Qualifying Long-Term Agreements within a maximum period of 12 months. The existing contracts would need to be extended to align with the re-procurement process, with the new contracts awarded commencing March 2024.

(2)                    To note that pursuant to delegated powers officers were procuring a suitably experienced Technical Consultancy that would manage the preparation of the specifications and support the procurement of the new M&E contracts.

(3)                    To approve inviting tenders for the M&E Contracts detailed in the table in paragraph 3.6 of the report.

(4)                    To delegate authority to the Corporate Director of Resident Services, in consultation with the Cabinet Member for Housing, Homelessness and Renters Security, to agree pre-tender considerations in respect of the M&E Contracts referred to in (3) above and thereafter evaluate tenders on the basis of the agreed evaluation criteria.

(5)                    To delegate authority to the Corporate Director of Resident Services, in consultation with the Cabinet Member for Housing, Homelessness and Renters Security, to award M&E Contracts referred in (3) above.

(6)                    To approve the allocation of £64 million exclusive of VAT over a period of 10 years from revenue and capital to fund the M&E Contracts referred to in (3) above, in accordance with the detail set out in paragraph 3.6 of the report.

(7)                    To note that the Council would undertake consultation with leaseholders and Recognised Tenants Associations pursuant to Section 20 of the Landlord and Tenant Act 1985 (as amended), as set out in paragraph 7.4 of the report.

To request approval to award the contract for the provision of Grounds Maintenance Services, following the completion of consultation with BHM Leaseholders and approval by Cabinet on 16 January 2023 to award the contract subject to the outcome of the consultation.

Following Cabinet approval to award and completion of consultation with BHM Leaseholders, the Corporate Director Resident Services in consultation with the Lead Member for Environment, Infrastructure and Climate Action:

i)             Approves the award of contract for the provision of Grounds Maintenance Services to Continental Landscapes Ltd for an initial contract period of eight (8) years, with an option to extend for a further eight (8) year contract period. The value of the contract is estimated to be circa £2.2m per year, or circa £17.6m over the initial 8 year term of contract, or circa £35.2m over the full 16-year contract period (excluding VAT, CPI indexation and AWE increases).

To award a contract for Generic Floating Support and Older Peoples Floating Support.

That the Corporate Director Adult Social Care and Health, in consultation with the Cabinet Member for Adult Social Care:

i)             Approves the award of contract for generic floating housing related support services for adults to Penrose, for a period of thee (3) years, with an option to extend for up to a maximum of two (2) years at a contract value of £752,380 per annum.

Award of a contract for Microsoft Azure for the Shared Technology Services boroughs of Brent, Lewisham and Southwark.

That the Cabinet Member for Finance, Resources and Reform, having consulted with the Leader:

i)             Approves the award of contract for the provision of Microsoft Azure for the Shared Technology Services Boroughs to Bytes Software Services Limited for a term fo three years, in the estimated sum of £4,844,130.

This decision concerns the procurement of hardware for the Wi-Fi Solution at Tooley Street for the London Borough of Southwark undertake through the IT Shared Service.

To approve the award of the contract for the provision of hardware for Wi-Fi Solution at Tooley Street, Southwark for a five year term commencing 03 March 2023.
