Application by Environmental Health, London Borough of Brent, for a review of the premises licence for 'Mama Calabar' (Dexion House, Empire Way HA9 0EF) pursuant to the provisions of the Licensing Act 2003
Decision:
Having considered the application by Environmental Health, London Borough of Brent, to review the premises licence for ‘Mama Calabar’ (Dexion House, Empire Way, HA9 0EF) pursuant to the provisions of the Licensing Act 2003, the sub-committee resolved that the premises licence continue in force but with an amendment to the hours that the premises is permitted to remain open and undertake licensable activities and additional conditions.
(i) that the following amendment to the hours during which the premises is permitted to remain open and undertake licensable activities as set out in the existing premises licence be:
Monday to Sunday: that the premises close and all licensable activities to cease at 02:00 (the following day).
(ii) that the following conditions be added to the premises licence:
1. No amplified noise or vibration from the activities at Mama Calabar shall be detectable at any neighbouring noise sensitive premises.
2. The licensee shall actively manage the external areas including the car park and ensure that controls are implemented to prevent noise from patrons disturbing local residents.
3. That signage be placed on the premises requesting that patrons leave the premises quietly and show due consideration to local residents.
The Alcohol and Entertainment Licensing Sub-Committee (C) felt that there had been sufficient evidence presented in the representations from Environmental Health of public nuisance due to noise. By making an amendment to the opening hours and to licensable activities and adding the conditions above, it felt that this would help the licensee address these concerns to uphold the licensing objective in relation to prevention of public nuisance.
