This application was adjourned at the meetings of Alcohol and Entertainment Licensing Sub-Committee (C) on 12 February 2013 and Alcohol and Entertainment Licensing Sub-Committee (A) on 7 June 2013 respectively. Additional documents:
Decision: Having considered the application by Safer Streets to review the premises licence for ‘Moonbay’ (1-2 Court Parade, East Lane, Wembley, HA0 3HY) pursuant to the provisions of the Licensing Act 2003, the Sub-Committee resolved that the premises licence continue in full force and effect subject to an amendment to licensable activities.
That the following amendment be made to the premises licence:-
That there be no regulated entertainment after 23.00 Monday to Sunday, with the exception of the use of televisions and monitors, until such time that an acoustics survey has been undertaken to identify any acoustic weaknesses and to address these to prevent any further incidents of public nuisance to adjacent properties.
The Alcohol and Entertainment Licensing Sub-Committee (A) accepted the evidence of Safer Streets and noted that there had been numerous incidents of public nuisance in relation to noise attributed to the premises in the last seven years. In view of this, the Sub-Committee felt that on balance it was appropriate, reasonable and proportionate to remove the provision of regulated entertainment from the premises licence until the acoustic issues had been satisfactorily resolved in order to help the premises licence holder uphold the licensing objective in relation to the prevention of public nuisance given the history noise on the premises. Decision: That the application by Opendoor Card Ltd for a premises licence for ‘Unit 24a’ (Unimix House, Abbey Road, London, NW10 7TR) pursuant to the provisions of the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (A) felt that the application was weak and failed to demonstrate adequately how the applicant was to uphold the licensing objectives (prevention of crime and disorder, prevention of public nuisance, ensuring public safety and protecting children from harm) in their application. In addition, the applicant had not made any attempts to address the concerns raised in the police’s representation and had failed to attend the hearing of this Sub-Committee. In view of these circumstances, the application was accordingly refused.
