RESOLVED:
Having considered all the information and submissions for the application by the Metropolitan Police to review the premises licence for ‘Greenes Bar’ (362-364 Neasden Lane North, London NW10) pursuant to Section 52 of the Licensing Act 2003 (The Act), the Sub-Committee resolved that Mr Timothy Sheahan be removed as the Designated Premises Supervisor (DPS) and that the provision of live music be a licensable activity in order to promote the licensing objectives.
The Sub-Committee when arriving at its decision carefully considered all the information and submissions in light of the Council’s Statement of Licensing Policy, amended guidance issued from time to time under Section 182 of the Act. In all the circumstances, the Sub-Committee was satisfied that the premises have been badly managed and supervised and that there has been a flouting of the law. Accordingly, in all of the circumstances of the case it was felt that the decision of the Sub-Committee was reasonable, necessary and proportionate, taking into account the requirements recommended by the Police and Public Safety.
In arriving at its decision, the Sub-Committee expressed extreme concern about the structural layout of the premises which they felt did not comply with the premises license plan. The Sub-Committee requested that this must be regularised immediately and reminded Mr Timothy Sheahan that he was at risk of enforcement if this was not carried out.
