Decision:
that the application for a variation of the premises licence for ‘Flirtease’ (210 Preston Road, Wembley, HA9 8PB) pursuant to the provisions of the Licensing Act 2003 be agreed subject to conditions.
(i) that the following hours for the provision of licensable activities be agreed:-
that all licensable activities and timings presently permitted on the ground floor of the premises be extended to the basement lounge area.
(ii) that the following conditions be attached to the licence:-
(a) that the number of persons permitted to utilise the smoking and shisha area (the rear garden) will be restricted to 15 persons by the licensed door supervisor after 22:30
(b) that the smoking and shisha area (the rear garden) will be closed to members of the public from 23:30 and that the licensed door supervisor will ensure patrons are requested to come inside the main structure of the premises by this time to ensure that local residents living to the rear of the premises are not disturbed by noise from patrons.
The Alcohol and Entertainment Licensing Sub-Committee (C) acknowledged that there were sensitive and complex issues in respect of the application and was mindful of the points raised by the applicant, however there were concerns that the application in respect of the smoking and shisha (the rear garden) would raise significant concerns with regard to public nuisance, both in terms of noise and smoke, therefore the right balance needed to be struck. Due consideration was also given to the Council’s Statement of Licensing Policy and the representations made by the Council’s Environmental Health in respect of public nuisance. In view of these considerations, it was felt that whilst the variation in respect of the basement could be approved, conditions as suggested by Environmental Health should be added to the licence in respect of the smoking and shisha area (the rear garden) in order to uphold the Council’s licensing objective in respect of prevention of public nuisance.
