Minutes: Councillor HM Patel declared that as he knew the applicant Mr Patel, he withdrew from the meeting during consideration of items 8 and 9. The Sub-Committee added that the applicant should work more closely with the Police in respect of future events in order to safeguard the promotion of the licensing objectives.

Yogini Patel, Senior Regulatory Service Manager in introducing the matter stated that the application was for the sale of alcohol and provision of regulated entertainment on Saturday 24 December from 11:00 hours until 04:00 hours on 25 December 2011 with 70 persons expected to attend. She added that no other interested parties had raised objections to the application apart from the police for reasons which they would outline in their presentation. She informed Members of the various options the committee could take upon hearing the evidence of all parties involved.

With the approval of the premises licence holder’s representative, Constable McDonagh (Brent Police) circulated documents that catalogued complaints from local residents from antisocial behaviour to noise nuisance. In addition and during visits she had conducted to NW Bar the premises were not being protected by personnel displaying Security industry Authority (SIA) badges, rear fire exit doors could not be opened and there were no notices explaining the admission, search, drugs and weapons policies. These were a clear violation of some of conditions agreed by the Committee for the grant of the licence. PC McDonagh continued that when Mr Hussain, the applicant, was called to Wembley Police Station he was unsure and lacked the knowledge for a suitable arrangement for the events for which he had submitted the applications. She advised the Committee that without further details, it was impossible to manage the risks associated with the events. PC McDonagh submitted that the Police objected to the grant of temporary event notices for the premises on the grounds that they would not promote the licensing objectives.
In response to members’ questions, PC McDonagh stated that Mr Hussain was the bar manager during all four visits she had undertaken with the licensing officer and during which dancing was taking place and the premises were not secured by SIA registered staff. She added that although she had consulted with Mr Hussain about the breaches of licensing conditions, he failed to reach a satisfactory agreement with the Police and also failed to submit a risk assessment of the proposed events including details of the arrangements for the proposed events.
Case for the applicant
Mr Shahzad Hussain the applicant for the proposed events in his submission stated that he had engaged a disc jockey (DJ) for the events subject to the grant of licences. He continued that he would provide two door supervisors who would coordinate security by the use of intercommunicating radios. In order to further strengthen security, metal detectors would be made available as well as first aiders.
Mr Hussain continued that with only 70 persons expected to attend each event, the Police’s insistence on 5 door staff, 4 supervisors, 3 helpers including himself he would be left with only 58 guests for each event.
