Application by Brent Police Licensing Unit for a Review of the Premises Licence for 'Tonkey Gorilla (Tonkey Bites)' (539-541 Kingsbury Road, London, NW9 9EG) pursuant to the Licensing Act 2003. The application for review is on the grounds of prevention of crime and disorder.
Decision: Having considered the application by Brent Police Licensing Unit to Review the Premises Licence for ‘Tonkey Gorilla (Tonkey Bites)’ (539-541 Kingsbury Road, London, NW9 9EG) (“the premises”) pursuant to the Licensing Act 2003 the Sub-Committee resolved that the licence continue in force subject to amended conditions, (including deletion of conditions 2 and 3 in Annexe 3 of the licence) as agreed between the Police and the Applicant, and amendment of thehours of licensable activities to the following:-
(a) that all times stated on the licence as finishing at 03.00 or 03.30 be amended to 02.00 (b) that all times stated on the licence as finishing at 01.00 be amended to 00.00
Although there had been evidence of a number of serious incidents at the premises since it had opened, the Police considered that there had been a significant improvement since May 2009, and considering that the Police were satisfied that the premises remain open subject to the amended conditions and reduced hours agreed by the parties, the Sub-Committee agreed that licence remain in force subject to these amendments to the licence.

Application by Silverback Entertainment to transfer the Premises Licence for 'Tonkey Bites' (539-541 Kingsbury Road, London, NW9 9EG) pursuant to the Licensing Act 2003. The application is for the transfer of the Premises Licence from N & S Bars Ltd to Silverback Entertainment Ltd. Decision: The Sub-Committee heard that this application was withdrawn and accordingly this item did not need to be considered. |

The application is to vary the Premises Licence to specify an individual as a Designated Premises Supervisor.
Decision: The Sub-Committee heard that this application was withdrawn and accordingly this item did not need to be considered. |

Decision: The Sub-Committee heard that this application was withdrawn and accordingly this item did not need to be considered. |

Application by Brent Police Licensing Unit for a Review of the Premises Licence for 'Booty Food & Wine' (272 Neasden Lane, London, NW10 0AD) pursuant to the Licensing Act 2003. The application is for review is on the grounds of prevention of crime and disorder and protection of children from harm. Decision: Having considered the application by Brent Police Licensing Unit to Review the Premises Licence for ‘Booty Food & Wine’ (272 Neasden Lane, London, NW10 0AD) (“the premises”) pursuant to the Licensing Act 2003 resolved that the licence be revoked.
The Sub-Committee accepted the Police evidence that there had been a number of breaches of licensing requirements over a long period, including incidents of selling alcohol outside permitted hours and sale of alcohol to underage persons. They noted that the company trading at the premises had been convicted of selling alcohol to underage persons on 28 August 2008. In view of the number and seriousness of the incidents, the Sub-Committee was not satisfied that the premises licence holder would properly manage the premises and felt that the only appropriate course of action to be taken was to revoke the licence.

Application by N Yousaf and S Yousaf for a Variation of the Premises Licence for 'Booty Food & Wine' (272 Neasden Lane, London, NW10 0AD) pursuant to the Licensing Act 2003. The application for variation is to remain open for the sale of alcohol for 24 hours Monday to Sunday and to remove embedded conditions carried over from the old Magistrates’ Licence. |

Application by Brent Police Licensing Unit for a Review of the Premises Licence for "Preston Food & Wine" (268 Preston Road, Wembley, HA3 0PY) pursuant to the Licensing Act 2003 The application for review is on the grounds of the prevention of public nuisance, the prevention of crime and disorder, ensuring public safety and protection of children from harm. Decision: Having considered the application by Brent Police Licensing Unit to Review the Premises Licence for ‘Preston Food & Wine’ (268 Preston Road, Wembley, HA3 0PY) (“the premises”) pursuant to the Licensing Act 2003 the Sub-Committee resolved that the that the licence be revoked.
The Alcohol and Entertainment Sub-Committee (C) accepted the Police’s evidence that there had been numerous breaches of licensing requirements, including selling alcohol outside permitted hours and despite warnings from the Police. It was felt that this demonstrated a lack of effective management of the premises since the previous designated premises supervisor had left and the Sub-Committee could not be confident that the premises would be properly managed in the future. They therefore considered that the most appropriate course of action was to revoke the licence.

Application by Munir Hussain and Nazir Munir to vary the Designated Premises Supervisor on the Premises Licence for 'Preston Food & Wine' (268 Preston Road, Wembley, HA3 0PY) pursuant to the Licensing Act 2003. The application is to vary premises licence to specify an individual as the designated premises supervisor. Decision: That the application by Munir Hussain and Naziir Munir to vary the Designated Premises Supervisor on the Premises Licence for ‘Preston Food & Wine’ (268 Preston Road, Wembley, HA3 0PY) (“the premises”) pursuant to the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (C) felt that as the named designated premises supervisor on the application worked on the premises during the same period when a number of breaches of licensing legislation occurred, that the crime prevention objective would be undermined if the application was allowed.

Application by Wais Akbhari to vary the Designated Premises Supervisor on the Premises Licence for 'Spark Food & Wine" (108 Chamberlayne Road, London, NW10 3JO) pursuant to the Licensing Act 2003. The application is to vary a premises licence to allow the change of a designated premises supervisor. Decision: That the application by Wais Akbhari to vary the Designated Premises Supervisor on the Premises Licence for ‘Spark Food & Wine’ (108 Chamberlayne Road, London, NW10 3JO) (“the premises”) pursuant to the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (C) accepted the Police’s evidence that due to the location and busyness of the premises that strong management was required. It was also accepted that there had been recent breaches of licensing legislation and incidents demonstrating inadequate arrangement of the premises. As the proposed designated premises supervisor would only be on the premises 3 days a week and that there was a lack of other personal licence holders on the premises, it was felt that this would not be sufficient to manage the premises so as to avoid risk of undermining the crime prevention objective and accordingly the application for variation was refused.
