Application by Desta Walsh for a Temporary Event Notice by 'Klub Mirage' (332-336 Neasden Lane, London, NW10 0AD) pursuant to the Licensing Act 2003 The application is for the sale of alcohol and the provision of regulated entertainment from 05.00 to 07.00 on 31 January 2010.

RESOLVED:-
that the application by Desta Walsh for a Temporary Event Notice for ‘Klub Mirage’ (332-336 Neasden Lane, London, NW10 0AD) (“the premises”) pursuant to the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (C) accepted the police’s evidence that the risk assessment provided by the applicant did not provide sufficient security and therefore presented a significant risk of public nuisance, crime and disorder. In addition, the Sub-Committee also accepted the police’s evidence that the extra hours applied for would also present an increased risk of public nuisance, crime and disorder and accordingly the application was refused.

The Applicant
The applicant was neither present nor represented at the meeting.
The Sub-Committee delayed proceedings for 15 minutes to provide more time for the applicant to arrive, after which it decided to consider the application in the absence of the applicant or a representative of the applicant.
Linda Legister (Principal Licensing Adviser, Health Safety and Licensing) introduced the matter and drew Members’ attention to the requests as set out in the temporary event notice.
PC Nick Mortimer (Brent Police) confirmed that he had received a copy of the application on 5 January 2010. He began by stating that there had been 18 incidents of crime and anti-social behaviour since 25 December 2009 in the Neasden area which was considered a hotspot for such incidences. The premises had even had to contact the police to report staff being assaulted on 25 December 2009. PC Nick Mortimer advised that he had requested a risk assessment from the applicant, however the measures proposed did not justify the additional hours applied for in his view. In addition, Sergeant Adrian Adolphus and PC Nicola McDonald from Brent Police had visited the premises on 16 January 2010 and had been informed by Al Whitehead who worked at the premises that the temporary event notice had been submitted in order to circumvent certain licensing conditions, including the requirement that there be no entry or re-entry after 00.30. A number of other breaches had also been observed, and on 19 January 2010 the designated premises supervisor had been removed, yet the premises continued to operate which would be in breach of licensing regulations if alcohol was supplied.
The Chair enquired if the applicant was intending to issue a cover charge for the temporary event notice and what the present opening times were.
In reply, PC Nick Mortimer stated that the event was for a birthday party, however it appeared that a cover charge of £10 applied. The event was supposedly to celebrate the birthday of the main promoter. Members noted that the premises were currently licensed to sell alcohol until 04.30. In reply to further queries, PC Nick Mortimer felt that the application posed a risk of increasing crime and disorder in the area, with a particular concern being that customers from the premises on the opposite side of the road would create disorder by crossing the road to the applicant’s premises when the other closed.

Having considered the views of the applicant and the responsible authority, the Sub-Committee determined:-
