Application by the Metropolitan Police to review the premises licence for 'The Shop' (75 Chamberlayne Road, Kensal Rise, London NW10 3ND) pursuant to the provisions of the Licensing Act 2003 Decision: Having considered the application by the Metropolitan Police to review the premises licence for ‘The Shop’ (75 Chamberlayne Road, Kensal Rise, London, NW10 3ND) (“the premises”) pursuant to the provisions of the Licensing Act 2003 the Sub-Committee resolved that the premises licence continue in force but with a condition added to the licence.
that the following condition be added to the premises licence:-
that there be no amplified music played on the premises.
The Alcohol and Entertainment Licensing Sub-Committee (B) accepted the evidence presented by the Metropolitan Police, the council’s Nuisance Team and interested parties that there was sufficient evidence of public nuisance, particularly in respect of noise, related to the premises, and therefore felt that adding the condition above would assist the premises licence holder to uphold the licensing objectives.
The sub-committee also added the following informatives:-
(i) that should the premises licence holder wish to play amplified music or be permitted to allow drinking in the outside areas of the premises, that they be advised to apply for a variation of their premises licence accordingly (which will include an application for licensable entertainment activities in relation to amplified music)
(ii) that the premises licence holder be advised that should the terms of their current licence be breached again and if there have not been sufficient improvement in relation to the issues highlighted, they may be subject to another review which could ultimately lead to their licence being revoked. Minutes: Having considered the application by the Metropolitan Police to review the premises licence for ‘The Shop’ (75 Chamberlayne Road, Kensal Rise, London, NW10 3ND) (“the premises”) pursuant to the provisions of the Licensing Act 2003 the Sub-Committee resolved that the premises licence continue in force but with a condition added to the licence.
that the following condition be added to the premises licence:-
that there be no amplified music played on the premises.
The Alcohol and Entertainment Licensing Sub-Committee (B) accepted the evidence presented by the Metropolitan Police, the council’s Nuisance Team and interested parties that there was sufficient evidence of public nuisance, particularly in respect of noise, related to the premises, and therefore felt that adding the condition above would assist the premises licence holder to uphold the licensing objectives.

Application by Keith Anderson for a Temporary Event Notice for 'Tokyngton Community Association' (Sherrins Farm, St Michael's Avenue, Wembley, HA9 6SA) pursuant to the provisions of the Licensing Act 2003 Decision: That the application by Keith Anderson for a Temporary Event Notice for ‘Tokynton Community Association’ (Sherrins Farm, St Michael’s Avenue, Wembley, HA9 6SA) pursuant to the provisions of the Licensing Act 2003 be approved with conditions.
(i) that the temporary event notice be permitted on 25.08.2012 from 22:00 until 04:00 the following day (26.08.2012)
(ii) that the following conditions be added to the notice:-
(a) no noise or vibration shall be detectable at any neighbouring noise sensitive premises.
(b) licensed door supervisors shall ensure queuing potential patrons and patrons leaving the site behave in an acceptable manner and do not cause disturbance to the neighbours.
(c) the playing of live or recorded music shall not be permitted in any garden or external area of the building.
(d) the name and contact number(s) for person(s) in charge of the event shall be made available to Council and shall be contactable during the full duration of the event.
(e) that there be no amplified music after 02.00 on 26.08.2012
The Alcohol and Entertainment Licensing Sub-Committee (B) heard evidence from the council’s Nuisance Team Officer that the location of the proposed temporary event notice was in a quiet, residential area where there had been complaints with regard to loud music at the site previously. In view of this, the sub-committee felt that the conditions attached would assist the applicant in upholding the licensing objectives and it was felt that ceasing amplified music at 02:00 was appropriate considering the location of the event.
