Application by the Metropolitan Police for a Review of the Premises Licence for 'Conways 3' (2-3 Holmstall Parade, Burnt Oak Broadway, Edgware, HA8 5HX) pursuant to the Licensing Act 2003
Decision:
Having considered the application by the Metropolitan Police to Review the Premises Licence for ‘Conways 3’ (2-3 Holmstall Parade, Burnt Oak Broadway, Edgware, HA8 5HX) (“the premises”) pursuant to the Licensing Act 2003 the Sub-Committee resolved that the licence continue in force subject to amendments to conditions as follows:.
(i) that the following hours for the provision of licensable activities be specified:-
(a) that the hours during which the premises licence holder is permitted to provide live music be:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 10.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(b) that the hours during which the premises licence holder is permitted to provide recorded music be:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 10.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(c) that the hours during which the premises licence holder is permitted to provide performances of dance be:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 10.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(d) that the hours during which the premises licence holder is permitted to provide anything similar to performance of live/recorded music or dance be:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 10.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(e) that the hours during which the premises licence holder is permitted to provide entertainment facilities for making music be:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 10.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(f) that the hours during which the premises licence holder is permitted to provide entertainment facilities for dancing be:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 10.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(g) that the hours during which the premises licence holder is permitted to provide facilities for entertainment of a similar description to making music or dancing:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 10.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(h) that the hours during which the premises licence holder is permitted to provide late night refreshments:
Sunday to Thursday – 23.00 to 00.00
Friday and Saturday – 23.00 to 01.00 (the following day)
(i) that the hours during which the premises licence holder is permitted to supply alcohol be:
Monday to Thursday – 10.00 to 00.00
Friday and Saturday – 23.00 to 01.00 (the following day)
Sunday – 12.00 to 00.00
(j) that the hours during which the premises licence holder is permitted to remain open be:
Monday to Thursday – 10.00 to 00.30 (the following day)
Friday and Saturday – 10.00 to 01.30 (the following day)
Sunday – 12.00 to 00.30 (the following day)
(ii) that all embedded conditions (and non-standard timings) on the existing premises licence be removed:-
(iii) that the following additional conditions be attached to the licence:

(a) that CCTV shall be installed to Home Office Guidance standards and maintained in a good working condition and recordings shall be kept for 31 days and shall be made available to police and licensing officers if requested;
(b) that customers shall not be permitted to take open glass containers outside the premises as defined on the plan submitted to and approved by the Licensing Authority that customers shall not be permitted to exit through the rear door of the premises into the outside rear area;
(c) that the total number of people permitted on the premises including staff and performers shall not exceed 280 persons;
(d) that a copy of the premises licence summary including the hours during which licensable activities are permitted shall be visible from the outside of each entrance to the premises;
(e) that notices asking customers to leave quietly shall be conspicuously displayed at all exits;
(f) that no noise or vibration shall be detectable at any neighbouring noise sensitive premises; and
(g) that all doors and windows shall remain closed during any licensable activity and where a door is used for patrons to enter or leave the premises the door shall be lobbied and fitted with a self-closing device.
The Alcohol and Entertainment Licensing Sub-Committee (B) accepted that there might have been confusion over licensable hours (due to the embedded conditions carried over from the previous licence) and therefore considered that these embedded conditions should be removed. The Sub-Committee considered that the imposition of a specific closing time and clear hours for licensable activities, with the other conditions imposed, will address issues concerning nuisance to local residents.
