Application by the Metropolitan Police to review the premises licence for 'Bar No. 8' (305 Willesden High Road, London NW10 2JT) pursuant to the provisions of the Licensing Act 2003
The review of the premises licence follows the expedited review of the premises that was considered by Alcohol and Entertainment Licensing Sub-Committee (C) on 5 August 2014.

Neither the premises licence holder nor a representative were present at the hearing.
Members considered whether to proceed with the application in the absence of the premises licence holder and a representative. PC Sam Lewis-Evans then referred to correspondence between the premises licence holder and herself and with the approval of the Chair, she distributed this to the sub-committee. Members noted that the premises licence holder had indicated that he would not be attending the hearing, however he would be happy for the application to be heard in his absence. In view of this, the sub-committee agreed to consider the application.
Yogini Patel (Senior Regulatory Services Manager, Environment and Protection) introduced the matter and set out the grounds on which the review of the premises licence had been made, these being crime and disorder, public nuisance and public safety.
Horatio Chance (Legal Adviser) then advised the sub-committee of the various actions it could take upon considering the application to review the premises licence.

PC Sam Lewis-Evans (Brent Police) submitted her evidence and confirmed that the premises licence holder had agreed to some conditions, including that drinks must only must be served in polycarbonate or plastic drinking vessels. However, an agreement on other conditions she had requested had not been reached, and as the premises licence holder was not intending to vary the hours of licensable activities, PC Sam Lewis-Evans requested that all the conditions she had requested be included on the premises licence.
PC Sam Lewis-Evans then responded to questions from members with regard to the nature of the premises licence holder’s business, CCTV and the existing conditions 11 and 14 on the premises licence. Nick Mortimer (Brent Police) added that condition 14 could be amended to reflect the usual wording of such a condition.

Members considered the written responses to the Police’s requests from the premises licence holder.
At this point, the responsible authority was asked to leave the room to allow the sub-committee to discuss the relevant issues of the application in closed session.
RESOLVED:
Having considered the application by Brent Police to review the premises licence for ‘Bar No. 8’ (305 Willesden High Road, London NW10 2JT) pursuant to the provisions of the Licensing Act 2003 (“The Act”), the Sub-Committee resolved that the premises licence continue in full force and effect, subject to amendments to existing conditions, additional conditions and informatives.
(i) that the following amendments be made to the existing conditions as numbered below on annexe 2 of the premises licence to read:
1. A CCTV camera shall be installed to cover the main entrance of the premises and further cameras installed to cover the Churchmead Road entrance/exit.
2. CCTV shall be installed to Home Office Guidance standards and maintained in a good working order and condition and recordings shall be kept for 31 days and shall be made available to Police and duly authorised officers from the Council on demand.
11. All doors entering/exiting onto Churchmead Road shall be closed at 21:30 and all customers are to leave via the High Road except in an emergency.
14. There shall be a minimum of two SIA approved door supervisors of a suitable gender mix to be employed from 21:00 on any day when the premises are open for the sale of alcohol past 00:00.
(ii) that the following conditions be added to the premises licence:
1. No drinks are to be served in glasses and must be served in polycarbonate or plastic drinking vessels.
2. That all bottled drinks are to be decanted into polycarbonate or plastic drinking vessels.
3. The licensee shall keep an incident log book on the premises at all times which shall be kept fully up to date and made available to the Police and the Licensing Authority on demand.
4. A copy of the premises licence summary including the hours which licensable activities are permitted shall be visible from the outside of each entrance to the premises.
5. The outside drinking areas shall cease at 22:00.
6. There shall be no drinking in the front entrance area of the premises.
The Alcohol and Entertainment Licensing Sub-Committee (C), in considering the evidence from the Police in their written representation, felt that amending existing conditions and adding additional conditions as outlined above would help the premises licence holder uphold the licensing objectives (prevention of crime and disorder, prevention of public nuisance, ensuring public safety and protection of children from harm) and accordingly these were added to the premises licence.
The Alcohol and Entertainment Licensing Sub-Committee (C) also issued an informative advising the premises licence holder that should they wish to change the nature and hours of operation of the business, they should consider applying for a variation of the premises licence under the Act.
The Sub-Committee also added another informative expressing its disappointment at the non-attendance of the premises licence holder or representative at the hearing, especially as the review was necessary because of an earlier expedited review of the premises licence following an incident of serious crime and disorder.
