Purpose:

To consider representations received to the public consultation for the making of the immediate Article 4 Directions and to confirm the Article 4 directions.

Decision:

Having considered the summary of representations received, officer responses and recommendations, to approve the confirmation of the Article 4 Directions for Buck Lane Conservation Area, 114 and 116 Elms Lane, Northwick Circle Conservation Article (Inner), Northwick Circle Conservation Area (Outer) and Roe Green Conservation Area.

Reasons for the decision:

The Article 4 Directions help support the protection of the borough’s heritage assets through the removal of specified permitted development rights. The background of the need for the Article 4 directions was set out in the 28th May 2024 Cabinet Paper: Review of Brent’s Conservation Areas. Cabinet resolved to approve ‘the making of immediate and non-immediate Article 4 directions (as required)’.

 

Following consultation after the making of the Article 4 directions and consideration of the responses received this has provided no compelling reason to not progress with their confirmation and the continued removal of the permitted development rights for the respective areas.

Alternative options considered:

(a)    To not confirm any of the five Article 4 directions

(b)    Pursue new Article 4 directions for Buts Lane and Northwick Circle, whilst confirming Roe Green and Elms Lane

(c)    Confirm the five Article 4 directions

Parties Consulted: Prior to their confirmation, the Article 4 directions were subject to consultation for a minimum period of 21 days. Consultation occurred from the 1st August 2024 to 30th August 2024. A minimum of two public notices were placed within the respective areas as well as in the local press for the start of the consultation period. Notice was not served on individual property owners or occupiers as this was considered impractical, this is consistent with the exemption allowed. The consultation was also advertised on the Council’s ‘Have Your Say’ web platform, as well as notifications being sent to those on the Local Plan consultation database, including statutory consultees, and ward councillors, wider borough councillors through the members’ bulletin and other relevant groups.
