To request a variation to the design and build contract with Cosmur Construction (London) Ltd for the Oliver Goldsmith Primary School Dining Hall Project.
Decision:
That the Director – Property & Assets:
i) Approves the variation of the Design and Build Contract with Cosmur Construction (London) Ltd for the Oliver Goldsmith Primary School Dining Hall Project.
Reasons for the decision:
The contractor has suffered financially in the
current construction industry and so provided the Council with a
commercial proposal along with the outstanding items to be
completed which detailed the funding required to complete the
project and fully deliver the dining hall for the school. To this
end, Officers are seeking approval to vary the contract to complete
these works as part of this project.
Alternative options considered:
The Council could reject the commercial
proposal and to terminate the contract and seek to procure an
alternative contractor to complete the works.
This option was discounted as it would take significant time to
source an alternative contractor which would mean a delay in
providing the dining hall. Also, the cost for an alternative
provider would have been greater than the cost of the commercial
proposal from Cosmur Construction (London) Ltd due to risk of
taking on others work.
