Purpose:
In accordance with Contract Standing Order 112 this decision regards the extension of an Agreement entered into pursuant to Section 75 of the National Health Service Act 2006 with NHS England (London Region) for joint commissioning of Oral Health Promotion services for another 5 years.
Decision:
To confirm approval of the extension of an agreement entered into pursuant to Section 75 of the National Health Service Act 2006 with NHS England (London Region) for joint commissioning of Oral Health Promotion services in Brent for a period of 5 years
Reasons for the decision:
Section 75 of the National Health Service Act 2006 (“s75”) contains powers enabling NHS bodies (as defined in section 275 of the NHS Act 2006) to exercise certain local authority functions and for local authorities to exercise various NHS functions. NHS England (London Region) entered into a joint commissioning Agreement (“s.75 Agreement”) with the Council in 2017 in exercise of those powers. Officers are proposing to excerise the option to extend under the s.75 Agreement for a further 5 years.
The Council entered into a S.75 Agreement with NHS England for five years with the option to extend for a further five years. In order to deliver the service, NHS England commissioned a services contract with Whittington Health NHS Trust in 2017 to deliver the Oral Health Promotion Service on behalf of the Council and other parties and have recently extended this contract for another 5 years. Although the Council does not have a direct contractual agreement with Whittington Health NHS, the S.75 Agreement refers to the services being delivered by them and requires the parties to agree an annual Work Programme and budget. Officers are proposing the extension of the s.75 Agreement with NHS England to align with this contract.
Alternative options considered:
Officers have considered whether the Council should directly commission Oral Health Promotion services in Brent but have concluded that the provision of such services is best provided by way of a joint commissioning approach with NHS England (London Region). Retaining this resource within a larger Community Dental Service (CDS) provides resilience and allows access to clinical supervision and dental expertise. It will also ease the provision of an integrated CDS and oral health promotion to Brent special schools and the families of children attending those schools.
