Confirmation of Article 4 Directions for Wembley Growth Area and Alperton Growth Area, Strategic Industrial Locations and Locally Significant Industrial Sites

Purpose:

To consider consultation responses with associated officer comments and to confirm two made Article 4 Directions: one for Wembley Growth Area to require planning permission for change of use from office to residential; and one for Alperton Growth Area and Strategic Industrial Locations and Locally Significant Industrial Sites within Brent where the Council is the Local Planning Authority

Decision:

Having considered the consultation representations received on the Article 4 Directions, as detailed in Appendix A of the report, the Director of Regeneration and Environment in association with the Lead Member for Regeneration, Growth, Employment and Skills approves:

 

(1)       the Council’s confirmation of the non-immediate Article 4 Direction removing permitted development rights for Office (B1(a)), Light Industrial (B1(c)) and Storage or Distribution Centre (B8) to Residential (C3) within Strategic Industrial Locations, Locally Significant Industrial Sites and the Alperton Growth Area as set out in Appendix B of the report; and

 

(2)       the Council’s confirmation of the non-immediate Article 4 Direction removing permitted development rights for Office (B1(a)) to Residential (C3) within the Wembley Growth Area as set out in Appendix C of the report

Reasons for the decision:

The Council has become concerned about the impact of recent existing and proposed changes to permitted development rights in relation to Business (B1a, B1c and B8) uses to C3 dwelling houses.  It considers that this is adversely affecting its ability to properly plan for its area.  The changes have resulted in significant loss of employment premises, and also in some areas have started to compromise wider Local Plan designations, or allocations pursing wider regeneration objectives.

 

Following consultation eight responses were received with details provided in Section 3 and Appendix A of the report.  Consultation responses both supported and objected to the making of the Article 4 directions.  Taking account of the consultation responses, proceeding with a recommendation to confirm both Article 4 directions that have been made is, however, considered appropriate to protect the local amenity and wellbeing of the area and avoid potential harm to the proper planning of the area.

Alternative options considered:

The proposals set out within the report follow on from the Cabinet decision on 24 July 2017 to issue

 

a)        a non-immediate Article 4 Direction removing permitted development rights for Office (B1(a)), Light Industrial (B1(c)) and Storage or Distribution Centre (B8) to Residential (C3) within Strategic Industrial Locations, Locally Significant Industrial Sites and the Alperton Growth Area; and

 

b)        a non-immediate Article 4 Direction removing permitted development rights for Office (B1(a)) to Residential (C3) within the Wembley Growth Area

 

The report presents the outcome of the consultation undertaken in accordance with regulations on these Directions and details the responses received, together with officer recommendations.  As a result of the consultation feedback it is recommended to confirm the two Article 4 directions.
