Purpose:
To seek approval for the Council to enter into a Deed of Surrender of Part relating to the Peel Phase 4 lease to address a title plan overlap identified between Peel Phase 4 and the NWCC East site.
Decision:
RESOLVED to:
(1) Approve the Council entering into a Deed of Surrender of Part to the Peel Phase 4 Lease dated 29 June 2023 to remove the identified title overlap and regularise site boundaries.
(2) Authorise Legal Services to finalise and complete all associated legal documentation and registration requirements.
Reasons for the decision:
The Peel Phase 4 scheme forms part of the wider South Kilburn regeneration programme delivering mixed tenure housing and associated infrastructure
A review undertaken as part of a recent transaction involving Countryside Properties (UK) Limited (as developer) and the sale of a number of units in Peel Phase 4 and NWCC West identified that part of the NWCC East premises were included within the Peel Phase 4 demise plan and that there was an overlap of red line boundaries between the two schemes.
The Peel Phase 4 demise therefore requires amendment to exclude the overlapping parcel of land forming part of the NWCC East boundary.
Alternative options considered:
The overlap identified as part of the Transaction necessitates amendment to the area demised under the lease of Peel Phase 4 to align with the intended site boundaries and development strategy.
