Purpose:
This decision is seeking approval to appropriate the land known as 1-8 Neville House, Neville Road, London NW6 5BT, 1-64 Winterleys, Albert Road, London 2 NW6 5DR, 113-128 Carlton House, Canterbury Terrace, London NW6 5DX and Carlton Hall, Canterbury Terrace, London NW6 5DU, referred to as ‘Appropriation Land’ for development purposes from General Fund to HRA.
Decision:
Having considered any representations made by third parties, to approve:
(1) That the Appropriation Land is surplus to requirements and is no longer required for the purpose for which it is currently held; and
(2) following on from (1) above, that the Appropriation Land is to be appropriated for planning purposes pursuant to Planning Application Ref: 18/4920 and the subsequent Planning Permission obtained on 03rd July 2020.
Reasons for the decision:
In order to deliver the proposed New Council Homes at 1-8 Neville House, Neville Road, London NW6 5BT, 1-64 Winterleys, Albert Road, London NW6 5DR, 113-128 Carlton House, Canterbury Terrace, London NW6 5DX and Carlton Hall, Canterbury Terrace, London NW6 5DU, an appropriation of land is required. This process has been ongoing and in March 2023, an application was made by the Council, to the Secretary of State requesting permission to appropriate the ‘Appropriation Land’ for planning purposes, pursuant to section 19 of the Housing Act 1985, which has subsequently been approved.
Development of the Appropriation Land is considered to be within the public interest and will contribute to the economic and social-well-being of the area.
Alternative options considered:
All outstanding interests in the land have been acquired by private treaty. The land is now vacant and there are no leaseholders, secure tenants or tenants in the premises on the Appropriation Land.
There is a compelling case to appropriate the Appropriation Land for planning purposes. The Appropriation Land would serve in the public interest as developing new council homes outweighs the impact of such a development on individuals and their rights. In addition to new homes for Brent residents, the development will also contribute to improving the standards across the South Kilburn estate including landscaping.
On the 3rd July 2020 planning permission was granted for the Neville and Winterleys redevelopment scheme (which includes the Appropriation Land) under Planning Application Ref: 18/4920.
