Purpose:

To consider the outcome of the public consultation conducted from September to November 2021 for the installation of off-street parking controls within the Ellerslie Gardens estate and approve any necessary Traffic Management Order for the installation of off-street parking controls as a result.

Decision:

(1)     To agree that the Ellerslie Gardens estate should be subject to a Traffic Management Order (TMO) commencing from 5th January 2023.

 

(2)     To note that under the Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations 1996, within 14 days of making an order, notification must be made in writing to any person who has objected to the order and has not withdrawn the objection and, where the objection has not been wholly acceded to, shall include in that notification the reasons for the decision.

 

(3)     To approve that the Traffic Management Order Notice of Proposal is moved to the Notice of Making.

 

(4)     In satisfaction of the requirement set out in (2) and (3) above, note that this decision will be provided to the objector within the 14 days

Reasons for the decision:

Brent Housing Management have received complaints from housing residents regarding obstructive parking within their estates, including Ellerslie Gardens, and reports of non-housing residents parking in residents parking bays, which reduces parking availability for residents of the estate.

 

Vehicles parking in an unsafe and inconsiderate way within housing estate car parks, block roads and pavements, make it difficult to manoeuvre within the estate, as well as hindering access for the Council’s refuse collection vehicles. More seriously, unsafe parking can prevent fire engines and ambulances from getting to the estate for emergencies.

 

To address this issue, Brent Housing Management is proposing to improve parking enforcement within housing estate car parks through the introduction of a TMO. The introduction of a TMO will enable the Council to control parking within the housing estates car parks in the same way that it currently does on the public highway. This is carried out through regular and targeted patrols by civil enforcement officers who issue penalty charge notices to vehicles breaching parking restrictions.

Alternative options considered:

Following the outcome of public consultation conducted from September to November 2021 for the installation of off-street parking controls within the Ellerslie Gardens estate, it is proposed to amend the existing TMO introduced in November 2021 to cover parking controls across four housing estates in the Borough.  The proposal to extend parking controls to additional estates does not require the drafting of a new TMO but requires the existing TMO to be amended.
