Purpose:
To confirm approval to execute the Harrow School Collaboration Agreement on behalf of Brent Council as one of the One Public Estate (OPE) partners on the Northwick Park Masterplan project.
Decision:
That the Director of Property and Assets, in consultation with the Corporate Director of Finance and Resources:
i) Confirms approval to the execution of the Harrow School Collaboration Agreement.
Reasons for the decision:
The Harrow School Collaboration Agreement provides a legal framework for the Harrow School and the One Public Estate (OPE) partners to ensure that the delivery of the Northwick Park Masterplan is not constrained by any legal covenants and ensures progress of Harrow School’s development proposals.
Alternative options considered:
Options were discussed with an external law firm, which included that the One Public Estate (OPE) partners could take a view that the land covenants do not bind the development of the Northwick Park Masterplan; or make an application to the Upper Tribunal (Lands Chamber) for the covenants to be modified and/or discharged under section 84 of the Law of Property Act 1925.
Overall, OPE partners preference was to collaborate directly with Harrow School to ensure that the primary concerns of each party could be identified, and appropriate mitigations could be put in place and agreed by the terms of the Harrow School Collaboration Agreement.
