Purpose:
To seek authority to establish a street market at Church End Road and award a contract for the operation of the market.
Decision:
That the Director Property & Assets:
i) Approves the establishment of the Church End Road Market (‘The Market’).
ii) Notes that the Corporate Director Finance and Resources has granted an exemption from the requirement to obtain 3 written quotes in respect of a Services Contract to run The Market.
iii) Notes Contract Standing Order 89 considerations.
iv) Approves the award of a service contract for the running of The Market on behalf of the Council for a period of two years to Saunders Markets Limited.
Reasons for the decision:
Cabinet in November 2016 approved the Church End Road development scheme. Cabinet in February 2022 approved the temporary relocation of the current Church End Road Market (Church End Market) to enable the completion of the Church End redevelopment works. In order to commence development at the Church End Road site, the Church End Market has to relocate to Church End Road. In order to operate the Market on Church End Road, authority is required from the Director Property and Assets to establish the Market under the Food Act 1984.
The Council requires the services of a market operator to operate the market. Council Officers have sought and obtained an exemption from the requirement to obtain 3 written quotes in respect of a Services Contract from the Corporate Director Finance and Resources.
Alternative options considered:
Officers considered the best means of operating the Church End Road Market and concluded that establishing the Market on Church End Road pursuant to the Food Act 1984 is the best means of operating the Market.
Officers considered whether the Market could be operated by the Council itself but concluded that the operation of the Market is best provided by a contractor with the necessary experience, skills and resources.
Officers reviewed a range of procurement options but consider that a direct award to the named contractor is the most appropriate means of procurement.
