Purpose:
To request approval to use a framework to procure a contractor to design and build the Special Educational Needs and Disabilities (SEND) School proposed for London Road, and set out the relevant pre-tender considerations.
Decision:
That the Director Property and Assets:
i) Approves Brent Council’s participation in a call-off procedure under the Department for Education (DfE) MMC1 Offsite Schools Framework Agreement Lot 2 Scheme GIFA Range 750m2 to 6,000m2 in respect of a design and build contract for the London Road SEND School.
ii) Confirms there is sufficient budgetary provision for the proposed call-off contract.
iii) Approves inviting bids under the framework agreement referred to in (i) for the London Road SEND School contractor on the basis of the pre-tender considerations.
iv) Approves officers evaluating bids on the basis of the evaluation criteria.
Reasons for the decision:
The Council requires a contractor to design and build a new SEND school at London Road. It has been determined the most appropriate means of procuring the contractor by way of a mini competition under the DfE MMC1 Offsite Schools Framework Agreement Lot 2.
The Council is proposing to appoint a contractor using this framework as it allows access to economical build rates owing to the proposed volume of work expected to be called off. These would not be available using alternative procurement means.
Alternative options considered:
Officers reviewed a range of options, including conducting a tender process, but concluded the Framework was the most appropriate means of procuring a contractor given the reduction in time-scales, costs and resources involved.

Parties Consulted: The Lead Member for Children, Young People & Schools, and the Lead Member for Finance, Resources and Reform have been consulted on the SEND Capital Programme progress and this specific project. Ward members will be kept up to date with project progress such as planning application submissions and works starting onsite. Upon approvla of the Free School Provider by the Regional Director, the Free School Provider will be a key stakeholder during the project's progress.
