Application by the Metropolitan Police for the review of a premises licence held by Timothy Sheahan for premises “Greenes Bar”, (362-364 Neasden Lane North, NW10 0BT) pursuant to the provisions of the Licensing Act 2003.

Minutes: The committee had before it the papers circulated with the agenda for the application together with supplementary documents. Members heard that the applicant had requested that consideration of the application be deferred to a later date as the licensee was out of the country.

Premises licence holder and representative present

The Chair introduced members of the committee and set out the procedure for the hearing including the order in which representations would be made.
The licensing officer, Yogini Patel, outlined the terms of the application which was for the sale of alcohol and provision of regulated entertainment on Saturday 20 June 2015 from 02:00 hours until 05:00 hours the following morning. She also advised that the premises was currently licensed for regulated entertainment from 19:00hrs to 01:30hrs, the sale of alcohol from 11:00hrs to 02:00hrs and late night refreshment from 23:00hrs to 00:00hrs and to remain open until 02:30hrs Monday to Sunday.
The Legal Officer set out the role of the committee under the Licensing Act 2013 to be fair and democratic and that regard would be had to the Human Rights Act 1998 and its powers namely to accept or reject or impose conditions as per the licence granted.
Representation from the objectors
Nick Mortimer outlined the objections to the application for a temporary event notice which was on the grounds of crime and disorder and public nuisance concerns.
Mr Mortimer circulated with the applicants consent witness statements in connection with a visit to the premises on Friday 12 June at 23:30 which included photographs showing people outside the premises and the proximity to residents. Mr Mortimer referred to the width of the road which was just wide enough for two parked cars and two cars passing. Mr Mortimer read out the statement from PC Michael Sullivan which referred to the nuisance observed outside the premises by people and passing by in cars and also the response of the applicant. He also reported on the conversation with a local resident who complained about the noise nuisance and was concerned at the proposal to extend the hours of operation.
Questions to the objector
In response to a question from the Licence holder’s agent, Ms Debra Sylvester, Nick Mortimer advised that the complainant lived sufficiently close so to be able to experience the noise disturbance.
Premises licence holder
Mr Vekaria made a statement to the committee in support of his application and advised of the staffing and sound limiter arrangements in place for the event in question. He assured that the limiter was due to be fully functioning by the following day, advised that private events been conducted without door staff following a risk assessment, acknowledged the front of the premises as the only designated smoking area and considered that disturbances were possibly caused by members of the public from other venues.
