Minutes: The Chair stated that members of her political organisation had attended ‘Alisan’ (1 The Junction, Wembley Retail Park, Engineers Way, Wembley HA9 0EG) in the past during fund raising events, however no members of the committee had directly organised the event, nor personally knew the premises licence holder or anyone associated with them and so did not view this as a prejudicial interest that was likely to affect their decision making when deciding the application. Accordingly, members remained present to discuss and consider the application. |

Having considered the matter, the Sub-Committee then asked the police and the premises licence holders to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
Having considered whether it was necessary to take interim steps under section 53B of the Licensing Act 2003 (“The Act”) pending the hearing of the application by the Metropolitan Police for an expedited review of the premises licence for ‘Metropolis/Alisan’ (1 The Junction, Wembley Retail Park, Engineers Way, Wembley HA9 0EG) pursuant to the provisions of the Act , the Sub-Committee resolved that the premises licence be suspended as an interim step on the grounds of serious crime and disorder under section 53B 3 (d) of the Act (as inserted by section 21 of the Violent Crime Reduction Act 2006)pending the full review.
The Alcohol and Entertainment Licensing Sub-Committee, having considered the evidence in the police’s written representation that included a number of incidents associated with the premises involving serious crime and disorder, including the most recent incident involving attempted murder on 30 March 2015, felt that the premises licence holder was unable to sufficiently uphold the promotion of the licensing objectives (prevention of crime and disorder, ensuring public safety, prevention of public nuisance and protection of children from harm). The Sub-Committee when arriving at its decision considered all of the evidence having regard to the Council’s Statement of Licensing Policy, amended guidance issued from time to time under section 182 of the Act, with particular reference to the Summary Review Guidance and the licence holders human rights under the Human Rights Act 1998 (namely Article 8, Article 6 and Article 1 of the First Protocol (incorporating the European Convention on Human Rights).
Accordingly, the Sub-Committee felt it was reasonable, proportionate and necessary in all of the circumstances of the case to suspend the premises licence pending the full review.
The Alcohol and Entertainment Licensing Sub-Committee also issued an informative advising that the premises licence holder liaise with the police concerning the management of the premises, in particular in relation to the action plan, during the time period up until the full review. |
