Minutes: The Sub-Committee was informed that the premises licence holder had not received the relevant documents with regard to the hearing at least ten working days before the day of the hearing as required under the Licensing Act 2003. In addition, the hearing date did not fall within the 20 working days from the day after the consultation period had ended following the submission of the application to review the premises licence, as also set out in the Licensing Act 2003. Accordingly, the Sub-Committee noted that the application could not be considered. |

The premises licence holder was neither present, nor represented at the hearing, however they had made a request to adjourn the application due to family reasons.
RESOLVED:
That the application by the Metropolitan Police to review the premises licence for ‘Variety Food & Wines’ (261 High Road, London, NW10 2RX) pursuant to the provisions of the Licensing Act 2003 be adjourned.
The Alcohol and Entertainment Licensing Sub-Committee (C) noted the request from the premises licence holder on the day of the hearing to adjourn the application due to family reasons. In the interests of natural justice the Sub-Committee exercised its discretion to adjourn the matter under regulation 12 of the Licensing Act 2003 (Hearings) Regulations 2005. The Sub-Committee also stated that should the applicant fail to attend a future hearing for whatever reason, then the application may be considered in his absence. During the decision making process Members had regard to the applicant’s human rights under Articles 6 and 8 of the Human Rights Act 1998 (incorporating the European Convention on Human Rights).
The Sub-Committee noted that the premises licence holder had been asked to submit their request for an adjournment in writing, setting out the reasons for the request. |

Having considered the matter, the Sub-Committee then asked the police, the premises licence holder and their representative to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
Having considered the application by the Metropolitan Police to review the premises licence for ‘Sudbury A-Z Newsagents’ (711 Harrow Road, Wembley, HA0 2LL) pursuant to the provisions of the Licensing Act 2003, the Sub-Committee resolved that the premises licence continue in full force and effect, subject to conditions as agreed with the police with an amendment to one of these conditions and additional conditions.
(i) that the following condition as agreed with the police in relation to CCTV be amended to read:
CCTV shall be installed to Home Office Guidance standards and maintained in a good working condition and recordings shall be kept for 31 days and shall be made available to the police and officers of the council on demand.
(ii) that the following conditions be added to the premises licence:
1. There shall be no sale of single cans of alcohol at any time.
2. All high strength beers, lagers and ciders above 6.0% ABV currently stocked on the premises to be removed by midnight on 8 December 2014.
The Alcohol and Entertainment Licensing Sub-Committee (C) acknowledged the premises licence holder and the police had come to an agreement about a number of conditions that were to be added to the premise licence and agreed that these would enable the premises licence holder to uphold the promotion of the licensing objectives (prevention of crime and disorder, ensuring public safety, prevention of public nuisance and protection of children from harm), subject to the amendment to the condition in relation to CCTV. The Sub-Committee also acknowledged the concerns raised in the police’s written representation in respect of alcohol being sold to street drinkers and felt that the additional conditions were reasonable, proportionate and necessary in helping the premises licence holder to address these concerns and further enable him to uphold the promotion of the licensing objectives (prevention of crime and disorder, ensuring public safety, prevention of public nuisance and protection of children from harm). |
