Declarations of personal and prejudicial interests Members are invited to declare at this stage of the meeting, any relevant financial or other interest in the items on the agenda. Decision: Councillor Jones declared an interest in relation to item three on the agenda (McGowan, 88 Walm Lane) as a ward councillor for the area and as being a recipient of complaints from local residents concerning planning applications in the area. However, the interest was not considered prejudicial and she remained present when this item was presented to the sub-committee. Application by Punch Pub Company for a variation of the premises licence for 'The Torch' (1-5 Bridge Road, Wembley, HA9 9AB) pursuant to the provisions of the Licensing Act 2003 Decision: that the application by Punch Pub Company for a variation of the premises licence for ‘The Torch’ (1-5 Bridge Road) (“the premises”) pursuant to the provisions of the Licensing Act 2003 be agreed with conditions.
(i) that the following provision of licensable activities be agreed:-
(a) that an external bar servery be permitted at the location as amended in the amended plans circulated at the meeting.
(b) that the sale of alcohol be permitted at the external bar server subject to the conditions below.
(ii) that the following conditions be attached to the licence:- that on a Wembley Stadium Event day, unless agreed in advance by the police, the following conditions will apply:- (a) Outside drinks shed to be moved to the side of the premises as shown cross hatched in black on the attached plan circulated at the meeting identifying where the structure will be. (b) Entry on match days is only permitted with a valid ticket for the relevant team - so that no opposing supporters can gain entry. (c) A minimum of eight Security Industry Approved registered door supervisors on large event days. (d) All security wear high visibility jackets for ease of identity. (e) No bottles or cans are allowed to be taken onto the site and customers are checked for drugs and weapons on entry to the premises. (f) All entrances are radio controlled. (g) The entrance to the car park is narrowed to a width to be agreed subject seeking advice from the council’s public safety officer in order to control access to the car park. (h) Erection of steel fencing (approximately ten feet tall) around the complete front of the premises. This fencing blocks the view onto passers by (and in turn people looking in). (i) A comprehensive CCTV system is installed at the premises. (j) All drinks are served in plastic glasses. (k) The premises will cease licensable activities and be cleared of customers one hour before the start of the event. The Premises will be permitted to resume licensable activities no later than one hour after full time or earlier in agreement with the police. (l) The number of persons permitted entry on a match day is restricted to 588 including staff who shall be monitored by door supervisors.
The Alcohol and Entertainment Licensing Sub-Committee (C) felt that the conditions suggested by the police and as amended as set out above would help the applicant meet the licensing objectives. In addition, there was no evidence to suggest that the application would undermine the licensing objectives and accordingly the variation of the premises licence was agreed.
The sub-committee also suggested an informative advising the applicant to seek clarification from the council’s Planning Service as to whether the application also requires planning permission.

Application by the Environmental Health Noise Nuisance Team to review the premises licence for 'McGowan' (88 Walm Lane, London, NW2 4QY) pursuant to the provisions of the Licensing Act 2003 Decision: The Sub-Committee noted that this application had been adjourned at the request of the Environmental Health Noise Nuisance Team and with the agreement of the premises licence holder and the police who had also made a representation on this application. Application by Power Leisure Bookmakers Ltd for a betting premises licence for 'Paddy Power' (206 Ealing Road, Wembley, Middlesex, HA0 4QG) pursuant to the provisions of the Gambling Act 2005 Decision: that the application by Power Leisure Bookmakers Ltd for a betting premises licence for ‘Paddy Power’ (206 Ealing Road, Wembley, Middlesex, HA0 4QG) (“the premises”) pursuant to the provisions of the Gambling Act 2005 be agreed with all conditions as set out by the police, save an amendment to a condition relating to staff numbers to be worded as follows:-
that the premises shall be staffed by a minimum of two persons from 13:00 Monday to Sunday.
The Alcohol and Entertainment Licensing Sub-Committee (C) felt that the evidence provided by the police concerning crime and disorder and its association with gambling premises was sufficient reason for all the conditions requested by the police be attached to the licence. It agreed with the police’s view that a maglock electric door release should be installed at the entrance door to the premises controlled by staff and to be used at all times to ensure its effectiveness in preventing customers from entering the premises where they are perceived as presenting a crime and disorder risk to other customers and staff as well as to promote the licensing objective linked to crime and disorder. The sub-committee acknowledged the applicant’s offer to ensure that there would be a minimum of two staff present on the premises at all times from 13.00 Monday to Sunday. It accordingly amended the condition set out by the police as it was accepted that the premises would usually be less busy before these times and crime and disorder concerns would be sufficiently addressed earlier in the day by the fact that the maglock electric door release was to be used by staff at all times. Application by Rajendra Shah for a premises licence for 'Shri Ram Restaurants' (201 Kenton Road, Harrow, HA3 0HD) pursuant to the provisions of the Licensing Act 2003 Decision: that the application by Rajendra Shah for a premises licence for ‘Shri Ram Restaurants’ (201 Kenton Road, Harrow, HA3 0HD) (“the premises”) pursuant to the provisions of the Licensing Act 2003 be granted with conditions.
(i) that the following hours for the provision of licensable activities be agreed:-
that the hours during which the applicant is permitted to provide live music as under Box E, recorded music as under Box F, performances of dance as under Box G, anything of a similar description to that falling within Boxes E, F or G as under Box H, provision of facilities for making music as under Box I, provision of facilities for dancing as under Box J, provision of facilities for entertainment of a similar description to that falling within Boxes I and J as under Box K and the hours that the premises are open to the public under Box O of the operating schedule be:
Monday to Sunday – 10.00 to 23.00, unless there has been a pre-arranged booking for an event in which case the licensable activities may continue until 01.00 the following day.
(ii) that the following conditions be attached to the licence:-
(a) that a qualified sound engineer be appointed to check and ensure the quality of the sound proofing prior to the premises opening to the public
(b) that a noise limiter set at a level agreed by the council’s Licensing Unit shall be used at all times.
(c) that a record of pre-booked events be kept and be made available for inspection to council officers upon request.
The Alcohol and Entertainment Licensing Sub-Committee (C) acknowledged the concerns raised by local residents in respect of prevention of public nuisance concerning noise, however it felt that the attached conditions would help the applicant meet the licensing objectives. In respect of the hours agreed for the licence, the sub-committee noted the applicant’s willingness to agree that the premises would normally close at 23.00, unless a pre-arranged event had been booked. The sub-committee therefore accordingly approved the application for a premises licence with the conditions and hours as set out above.
The sub-committee also added an informative confirming that no food was to be provided by the applicant after 23.00.

Application by Fouchia Hafe for a premises licence for 'Fi Fi's' (556 Kingsbury Road, London, NW9 9HJ) pursuant to the provisions of the Licensing Act 2003 Decision: that the application by Fouchia Hafe for a premises licence for ‘Fi Fi’s’ (556 Kingsbury Road, London, NW9 9HJ) (“the premises”) pursuant to the provisions of the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (C) noted the concerns raised by the police and the Environmental Health Officer and their suggested conditions in their representations. In view of the fact that the applicant had not responded to the representations and was not present at the meeting to provide a response and answer questions from the sub-committee, it was felt that there was insufficient evidence that the applicant would meet the licensing objectives and accordingly the application was refused.
