RESOLVED:
Having considered all the information and submissions for the application by the Metropolitan Police to review the premises licence for ‘Greenes Bar’ (362-364 Neasden Lane North, London NW10) pursuant to Section 52 of the Licensing Act 2003 (The Act), the Sub-Committee resolved that Mr Timothy Sheahan be removed as the Designated Premises Supervisor (DPS) and that the provision of live music be a licensable activity in order to promote the licensing objectives.
The Sub-Committee when arriving at its decision carefully considered all the information and submissions in light of the Council’s Statement of Licensing Policy, amended guidance issued from time to time under Section 182 of the Act. In all the circumstances, the Sub-Committee was satisfied that the premises have been badly managed and supervised and that there has been a flouting of the law. Accordingly, in all of the circumstances of the case it was felt that the decision of the Sub-Committee was reasonable, necessary and proportionate, taking into account the requirements recommended by the Police and Public Safety.
In arriving at its decision, the Sub-Committee expressed extreme concern about the structural layout of the premises which they felt did not comply with the premises license plan. The Sub-Committee requested that this must be regularised immediately and reminded Mr Timothy Sheahan that he was at risk of enforcement if this was not carried out.

RESOLVED:
Having considered all the information and submissions for the application by the Metropolitan Police to review the premises licence held by Mr Kannan Thangarasa for ‘Jeen Cash & Carry’ (306 Harrow Road, Wembley, HA9 6LL) pursuant to Section 52 of the Licensing Act 2003 (The Act), the Sub-Committee resolved that the following additional conditions be attached to the existing premises licence in relation to major football event days at Wembley Stadium:
· No sales of beer or cider in glass containers to be undertaken during this period and glass bottles except wines and spirits be removed from display · No more than four cans of beer or cider be sold to an individual · All persons buying alcohol, at any time, to be advised of the Street Drinking ban · No alcohol be sold one hour before the designated kick off time. Sales of alcohol can resume at the kick off time.
The Sub-Committee when arriving at its decision carefully considered all the information and submissions in light of the Council’s Statement of Licensing Policy, amended guidance issued from time to time under Section 182 of the Act. In all circumstances, the Sub-Committee felt that the above additional conditions were wholly reasonable, proportionate and appropriate measures to be put in place to promote the licensing objectives.

RESOLVED
Having considered all the information and submissions for the variation of premises licence for ‘Arada Mini Market (17 Malvern Road, London NW6) pursuant to Section 52 of the Licensing Act 2003 (The Act), the Sub-Committee resolved that the application by Mr Hamid Raza be refused in order to promote the licensing objectives.
The Sub-Committee when arriving at its decision carefully considered all the information and submissions in light of the Council’s Statement of Licensing Policy, amended guidance issued from time to time under Section 182 of the Act. The Sub-Committee concluded the application, if granted, would severely undermine the licensing objectives against a background of numerous serious breaches of licensing and other legal requirements, poor management and supervision of the premises. Members expressed a view that Mr Raza had not been open and honest with the responsible authorities and accepted that the objections evidence a pattern of irresponsible and unacceptable behaviour and a disregard for the licensing objectives. They continued that as the were not well run it did not enjoy the confidence of the Police or the Licensing Authority and accordingly did not think it would be appropriate to extend the hours.
The Sub-Committee advised Mr Raza to learn the lessons from the application and address concerns raised in order to avoid the risk of the responsible authorities applying for the premises to be reviewed.
