Additional documents: Decision: The Alcohol and Licensing Sub-Committee (B) having considered the evidence submitted by the Council’s Nuisance Control Team to review the premises licence for 5-7 Wembley Hill Road Wembley HA9 8AF) pursuant to section 52 of the Licensing Act 2003 (“The Act”), the Sub-Committee resolved that it would be unreasonable and disproportionate in all of the circumstances of the case to remove recorded music as a licensable activity from the scope of the licence given the limited evidence presented by the Responsible Authority and the degree of weight Members were expected to attach to such evidence during the decision making process. The Sub-Committee considered it reasonable and necessary to issue a 3 month warning only.
The Sub-Committee added an informative that the Nuisance Control Team work with the premises licence holder to assess the effectiveness of the sound insulation already installed at the premises so as to promote the upholding of the licensing objectives, in particular the objective relating to the prevention of public nuisance
The Sub-Committee when arriving at it’s decision duly considered the oral and written evidence in light of the Council’s Statement of Licensing Policy, amended guidance issued from time to time under Section 182 of the Act, and the licence premises holders human rights under the Human Rights Act 1998 (incorporating the European Convention of Human Rights) namely Article 6, Article 8 and Article 1 of the First Protocol. Having considered the matter, the Sub-Committee then asked the police and the applicants to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
