Minutes: Councillor B M Patel advised that he had visited the premises in the past in relation to item two on the agenda (First Class Sports Bar, 125 Wembley Park Drive, Wembley, HA9 8HQ). However, he did not personally know the premises licence holder and did not regard himself as having a prejudicial interest on the matter and accordingly remained present to consider this item. |

Having considered the matter, the Sub-Committee then asked the police and the premises licence holder’s representative to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
Having considered the application by the Metropolitan Police to review the premises licence for ‘First Class Sports Bar’ (125 Wembley Park Drive, Wembley, HA9 8HQ)) pursuant to the provisions of the Licensing Act 2003, the Sub-Committee resolved that the premises licence continue in full force and effect, subject to additional conditions, informatives and conditions added and deleted as agreed with the Metropolitan Police in their written representation.
that the following conditions be added to the premises licence in addition to the conditions added and deleted as agreed with the Metropolitan Police:
1. A personal licence holder fluent in English shall be present on the premises and supervise the sale of alcohol throughout the permitted hours for the sale of alcohol.
2. The level of music shall be arranged so as not to cause a nuisance to local residents.
3. Licensable activities shall only be permitted within the licensable area as delineated on the plan annexed to the premises licence.
The Alcohol and Entertainment Licensing Sub-Committee (B) acknowledged the conditions that had been added and deleted as agreed with the Metropolitan Police in their written representation and it was noted that the condition in relation to no entry or re-entry had been amended to 00:00 hours. The Sub-Committee also felt that it was reasonable, proportionate and necessary to add conditions to the premises licence as set out above in order to help the premises licence holder uphold the promotion of the licensing objectives (prevention of crime and disorder, ensuring public safety, prevention of public nuisance and protection of children from harm).
The Alcohol and Entertainment Licensing Sub-Committee (B) also issued an informative advising the premises licence holder to apply for a variation of the premises licence at the earliest opportunity. The Sub-Committee also reminded the premises licence holder of the importance in providing the licensing authority with accurate and up to date information. |

Having considered the matter, the Sub-Committee then asked the police, the licensing inspector and the premises licence holder to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
Having considered the application by the Metropolitan Police to review the premises licence for ‘Variety Food and Wines’ (261 High Road, London, NW10 2RX) pursuant to the provisions of the Licensing Act 2003, the Sub-Committee resolved that the premises licence continue in full force and effect, subject to additional conditions and an informative.
That the following conditions be added to the premises licence:
1. CCTV shall be installed to Home Office Guidance standards and maintained in a good working condition and recordings shall be kept for 31 days and shall be made available to police and authorised officers of the council on demand.
2. A sign stating ‘No proof of age – No sale’ shall be displayed at the point of sale.
3. A ‘Challenge 21’ policy shall be adopted and adhered to at all times.
4. A clear and unobstructed view into the premises shall be maintained at all times.
5. An incident log shall be kept at the premises and made available for inspection on demand to an authorised officer of the council or the police and it will record any refusal of the sale of alcohol.
6. A copy of the premises licence summary, including the hours during which licensable activities are permitted, shall be visible from the outside of each entrance to the premises.
7. A personal licence holder fluent in English shall be present on the premises and supervise the sale of alcohol throughout the permitted hours for the sale of alcohol.
8. Outside the hours authorised for the sale of alcohol, all alcohol within the trading area shall be suitably covered in order to prevent access to the alcohol by customers or staff.
9. Regular robbery awareness and cash minimisation training shall be given to all staff.
10. The designated premises supervisor is to keep a record of all staff employed at the venue which is to include names, addresses and national insurance details.
The Alcohol and Entertainment Licensing Sub-Committee (B), in considering the evidence from the Metropolitan Police in their written representation, accepted that there had been significant breaches of some of the conditions on the premises licence that undermined the licensing objectives (prevention of crime and disorder, prevention of public nuisance, ensuring public safety and protection of children from harm). The Sub-Committee also accepted evidence from the police that there were some shortcomings in respect of the management of the premises. Having considered the matter, the Sub-Committee then asked the police and the applicant to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
That the application by Akbar Lakhani for a temporary event notice on 20-21 December 2014 for ‘Alisan’ (1 The Junction, Wembley Retail Park, Engineers Way, Wembley, HA9 0EG) pursuant to the provisions of the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (B) accepted that the police had provided considerable evidence of crime and disorder that were associated with the premises. The sub-committee also felt that the premises licence holder had not adequately demonstrated that he would be able to uphold the promotion of the licensing objectives (prevention of crime and disorder, ensuring public safety, prevention of public nuisance and the protection of children from harm) and accordingly it refused the temporary event notice.
The Alcohol and Entertainment Licensing Sub-Committee (B) also issued an informative advising that the applicant hold discussions with the police in respect of modifying the premises because of the changes in the nature of the business taking place at the premises. It also advised that the applicant seek professional advice in respect of making appropriate changes to the premises. |
