Having considered the matter, the Sub-Committee then asked the police and the applicants to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
That the application by Moshin Aziz, Jahangir Akhtar and Rafaqat Choudry for a new premises licence for ‘Ladan General Trading’ (216 Church Road, London NW10 9NP) pursuant to the provisions of the Licensing Act 2003 be adjourned to the next available hearing date.
The Alcohol and Entertainment Licensing Sub-Committee (B) noted the request from the applicant to adjourn the application whilst the situation concerning the assignment of the lease was completed with the current tenant. Notwithstanding this, the Sub-Committee also acknowledged the police’s request for an adjournment so that they could meet with the applicant to set out what steps they felt were necessary for the applicant to uphold the promotion of the licensing objectives (prevention of crime and disorder, ensuring public safety, prevention of public nuisance and protection of children from harm) and to obtain more information about their operating schedule. The Sub-Committee therefore exercised its discretion to adjourn the matter under regulation 12 of the Licensing Act 2003 (Hearings) Regulations 2005. During the decision making process, members had regard to the applicant’s human rights under Articles 6 and 8 of the Human Rights Act 1998 (incorporating the European Convention on Human Rights). |

Having considered the matter, the Sub-Committee then asked the police to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
That the application by the Metropolitan Police to review the premises licence held by Louriston Michael Lorainey for ‘Bar 07 (Masters)’ (217 Kenton Road, Harrow, HA3 0HD) pursuant to the provisions of the Licensing Act 2003 be adjourned to the next available hearing date.
The Alcohol and Entertainment Licensing Sub-Committee (B) noted that the premises licence holder was not present for the hearing and neither were they represented, although they had failed to inform the licensing authority that they would not be attending the hearing. However, in the interests of natural justice the Sub-Committee exercised its discretion to adjourn the matter under regulation 20 of the Licensing Act 2003 (Hearings) Regulations 2005. The Sub-Committee also stated that should the applicant fail to attend a future hearing for whatever reason, then the application may be considered in their absence. During the decision making process, members had regard to the applicant’s human rights under Articles 6 and 8 of the Human Rights Act 1998 (incorporating the European Convention on Human Rights). |
