Application by Safer Streets and the Metropolitan Police to review the premises licence for 'McGowans' (88 Walm Lane, London, NW2 4QY) pursuant to the provisions of the Licensing Act 2003 Decision: Having considered the application by the Metropolitan Police and the Council’s Safer Streets department to review the premises licence for ‘McGowans’ (88 Walm Lane, London, NW2 4Q) (“the premises”) pursuant to the provisions of the Licensing Act 2003 the Sub-Committee resolved that the premises licence continue in force subject to a review and with conditions added to the licence.
(i) that the following conditions be added to the premises licence:-
(a) that all licensable activities must cease by 00:00 Monday to Sunday;
(b) that the hours during which the premises is permitted to open to the public be 00:30 (the following day) Monday to Sunday;
(c) that two door supervisors shall be present from 20:00 until all customers have been dispersed from the premises on Fridays and Saturdays to control entrance to the premises and to control order within the premises; and
(d) that a noise limiter be set at a level agreed by Brent Council’s Safer Streets shall be used at all times.
(ii) that the police and the Council’s licensing officers review the new arrangements at the premises over a three month period and to report back to the Council with their findings by 29 February 2012.
The Alcohol and Entertainment Licensing Sub-Committee (A) accepted the evidence presented by the Police and Safer Streets that there had been incidents of public nuisance and crime and disorder, some of which were of a serious nature, whilst there had also been breaches of the existing conditions on the licence. However, it was acknowledged that the licensee had taken some preventative steps to try and address these concerns but not far enough so as to achieve the promotion of the licensing objectives (Public Nuisance, Crime and Disorder, Prevention of Children form Harm). In the circumstances the sub-committee felt that by adding the conditions highlighted above, these would help the licensee meet the licensing objectives and it was also noted that the licensee had indicated a willingness to accept conditions with regard to door supervisors, a noise limiter and a reduction in the hours of licensable activities. The sub-committee felt that in view of the seriousness of the recorded incidents involving the premises and the past breaching of conditions, the premises should be reviewed by the police and the Council’s licensing officers over a three month period to assess whether the licensing objectives were being fully met.

Application by Metropolitan Police to review the premises licence for 'Diamond News Convenience Store' (4 Neeld Parade, Wembley, HA9 6QU) pursuant to the provisions of the Licensing Act 2003 Decision: Having considered the application by the Metropolitan Police and to review the premises licence for ‘Diamond News Convenience Store’ (4 Neeld Parade, Wembley, HA9 6QU) (“the premises”) pursuant to the provisions of the Licensing Act 2003 the Sub-Committee resolved that the premises licence continue in force subject to the following conditions being added to the licence:-
(i) CCTV shall be installed to Home Office Guidance standards and maintained in a good working condition and recordings shall be kept for 31 days and shall be made available to police and licensing officers on request; (ii) no high strength beers, lagers, and ciders above 5.5% ABV shall be stocked or sold; (iii) on major event
days at Wembley Stadium the following shall apply:
- (a) no more than four cans of beer, lager or cider to be sold to an individual. (b) no sales of beer, lager or cider above 5.5% abv during the above period. (c) all persons buying alcohol, at any time, to be advised of the Street Drinking ban (d) stop selling all alcohol one (1) hour before the scheduled kick off (e) be prepared to cease the sale of all alcohol should you be requested to do so by a police officer. (f) no drinks shall be displayed or sold in glass containers with the exception of wines and spirits; (iv) the following crime prevention measure shall be implemented:- a time delay safe with deposit slot and anti-fishing mechanisms must be used at the counter till area.
The Alcohol and Entertainment Licensing Sub-Committee (A) accepted the evidence from the police that the licensee had frequently breached the voluntary code of conduct agreed with all licensed premises within a one mile radius of Wembley Stadium on Wembley event days. It therefore agreed that the code of conduct be added as conditions to the premises licence in order that the licensee can uphold the licensing objectives. In addition, it felt that conditions relating to CCTV, high strength beers, lagers and ciders and a time delay safe would similarly enable the licensee to uphold the licensing objectives, as well as making the premises a safer environment for both customers and staff.

Application by Rajesh Rai for a variation of the premises licence for 'Peaches' (177-179 Kenton Road, Harrow, HA3 0EY) pursuant to the provisions of the Licensing Act 2003 Decision: that the application by Rajesh Rai for a variation of the premises licence for 'Peaches' (177-179 Kenton Road, Harrow, HA3 0EY) pursuant to the provisions of the Licensing Act 2003 be agreed with conditions as agreed by the police and Environmental Health.
The Alcohol and Entertainment Licensing Sub-Committee (A) noted that there remained an outstanding representation from Planning Services, however as it was not concerned with licensing matters, the variation of the premises licence was agreed subject to the conditions agreed with the police and Environmental Health. However, the sub-committee added an informative that the license clarify with Planning Services that they have the relevant planning permission.
