Application by DJ's Caribbean Limited for a variation of its' premises licence for 'The Heritage Inn' (301 Cricklewood Broadway, London, NW2 6PG) pursuant to the provisions of the Licensing Act 2003 The application was adjourned from a previous meeting of the sub-committee held on 8 February 2011. Decision: that the application by DJ’s Caribbean Limited for a variation of the premises licence for ‘The Heritage Inn’ (301 Cricklewood Broadway, London, NW2 6PG) pursuant to the provisions of the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (A) refused the application on the following grounds:-
(i) The sub-committee acknowledged the improvements the applicant had made in respect of sound insulation, however as these works were yet to be completed to the reasonable satisfaction of the Councils Director of Environment and Neighbourhood Services and despite a verbal Undertaking from the applicant that this would be completed within a few days of the adjourned hearing of the application on 8 February 2011, it did not consider the arrangements sufficiently satisfactory to address noise breakout from the premises; (Prevention of Public Nuisance)
(ii) The sub-committee noted that the applicant had failed to secure a contractual agreement with Wickes Building Supplies Limited for Heritage Inn customers to use their car park despite the applicant agreeing to pursue such an arrangement on 8 February 2011 and therefore felt that parking arrangements were not sufficiently secure to address the many reported incidents of public nuisance caused by vehicles of Heritage Inn customers parking in residential streets; (Prevention of Public Nuisance)
(iii) The sub-committee accepted the evidence provided by the Police with regard to incidents they had witnessed concerning public nuisance and public disorder incidents involving customers who had left the premises and also of the significant number of complaints they had received from residents with regard to public nuisance associated with the premises since the application had been adjourned; and (Prevention of Crime and Disorder, Prevention of Public Nuisance)
(iv) The sub-committee noted that the applicant’s dispersal policy for customers leaving the premises had not been finalised and neither had it been properly evaluated by the relevant authorities. (Prevention of Crime and Disorder, Prevention of Public Nuisance)
In view of the above reasons, the sub-committee felt that the application did not sufficiently meet the promotion of the licensing objectives (Prevention of Public Nuisance, Prevention of Crime and Disorder) and accordingly the application was refused.
In addition, the sub-committee communicated two informatives for the applicant’s attention:-
(i) that the applicant without further delay be advised to submit details of sound insulation works to the relevant authority for approval; and
(ii) that should the applicant wish to seek details of the names and addresses of those who had made representations against the application, that the applicant be advised to submit a formal request for consideration to the Councils freedom of information officer under the Freedom of Information Act 2000.
