Purpose:
To seek approval to the granting of one year lease at renewal for a peppercorn rent.
Decision:
To approve a new lease, for a term of one year at peppercorn rent to Meanwhile Space Social Enterprise Limited, contracted out of the Landlord and Tenant Act 1954 with a landlord break clause to terminate the lease at any time during the contractual term upon three months’ notice and a tenant break clause to terminate the lease at any time during the contractual term of the lease.
Reasons for the decision:
Brent Council acquired Ujima House in July 2017. The Council intends to redevelop the plot commencing summer 2022 as per the development plan for Wembley Housing Zone. Meanwhile Space have agreed to a new lease until 3rd July 2022 for a peppercorn rent. There is a break clause in favour of the landlord and the tenant. Given the regeneration plans, a letting at a peppercorn rent is considered best consideration and the letting for Meanwhile Space also helps to bring redundant space into productive use.
Alternative options considered:
The Council leased the building to Meanwhile Space, on a peppercorn rent commencing 3rd July 2018 for 3 years, following attempts to market the property on commercial terms. The lease expired on 2nd July 2021 and the Council has offered a new 1 year lease on the same terms save the reduced notice period of three months in the landlord only break clause.
