RESOLVED:
that the application by the Licensing Department to review the premises licence for ‘D Den’ (47 Cricklewood Broadway, London NW2 3JX) pursuant to the provisions of the Licensing Act 2003 be adjourned to the next available hearing date.
The Alcohol and Entertainment Licensing Sub-Committee (B) noted the request from the premises licence holder to adjourn the application so that they could obtain advice from their legal representative who had only recently been formally instructed. The Sub-Committee therefore exercised its discretion to adjourn the matter under regulation 12 of the Licensing Act 2003 (Hearings) Regulations 2005. During the decision making process, members had regard to the applicant’s human rights under Articles 6 and 8 of the Human Rights Act 1998 (incorporating the European Convention on Human Rights). Due to the severity of the review application, it was felt reasonable in all of the circumstances for the premises licence holder to be afforded a fair hearing under Article 6 as aforesaid. |

Having considered the matter, the Sub-Committee then asked the police, the applicant and the applicant’s representative to leave the room to allow the Sub-Committee to discuss the relevant issues concerning the application.
RESOLVED:
that the application by T’Jae Joscelyn Ellis for a temporary event notice for ‘BBMC’ (385 High Road, London NW10 2JR) pursuant to the provisions of the Licensing Act 2003 be refused.
The Alcohol and Entertainment Licensing Sub-Committee (B) acknowledged the evidence in the Metropolitan Police’s written representation circulated prior to the meeting outlining their concerns that a social media site was suggesting that people under the age of 18 (including two DJs due to perform at the event and girls representing being at child sexual exploitation risk) would be attending the event which involved adults and the supply of alcohol until 05.00 the following day. The Sub-committee could not ignore the representations advanced by the Police in the strongest possible terms in relation to the safeguarding of children and the selling of alcohol at the event. Furthermore, the Sub-Committee felt that the applicant had failed to demonstrate adequately what preventative measures would be put in place to alley the fears the Police and Members expressed in order to promote the licensing objectives (prevention of crime and disorder, ensuring public safety, prevention of public nuisance and the protection of children from harm), with particular emphasis on the protection of children from harm objective, and accordingly the application was refused. |
