Decision: That the application by Manuela Rodrigues to vary the premises licence for ‘O Estadio’ (31A Station Road, London, NW10 4UP) pursuant to the provisions of the Licensing Act 2003 be adjourned.
The Alcohol and Entertainment Licensing Sub-Committee (A) felt that in the absence of the applicant, the application should be adjourned to allow the applicant the opportunity to address the concerns raised by the Metropolitan Police, Environmental Health, Licensing officers, Public Safety and residents on the grounds of the four licensing objectives (prevention of crime and disorder, prevention of public nuisance, ensuring public safety and protection of children from harm) in their representations. In the interests of natural justice the sub-committee exercised its discretion to adjourn the matter under regulation 12 of the Licensing Act 2003 (Hearings) Regulations 2005. The sub-committee also stated that should the applicant fail to attend a future hearing for whatever reason, then the application may be considered in his absence. During the decision making process Members had regard to the applicant’s human rights under Articles 6 and 8 of the Human Rights Act 1998 (incorporating the European Convention on Human Rights).

Additional documents: Decision: Having considered whether it was necessary to take interim steps under section 53B of the Licensing Act 2003 pending the hearing of the application by the Metropolitan Police for an Expedited Review of the Premises Licence for ‘The Lounge’ (Unit 5 Unimax House, Abbey Road, London, NW10 7TR) (“the premises”) the Sub-Committee resolved that the premises licence be suspended as an interim step on the grounds of crime and disorder under section 53B (3) (d) of the Licensing Act 2003 (as inserted by section 21 of the Violent Crime Reduction Act 2006).
The Alcohol and Entertainment Licensing Sub-Committee (A) accepted the evidence from the police’s representation that there had been incidents of serious crime and disorder associated with the premises in addition to significant breaches of some conditions of the premises licence. The Sub-Committee felt that under the circumstances, the appropriate course of action to take in order to safeguard the promotion of the licensing objectives was a suspension of the premises licence as an interim step on the grounds of crime and disorder.
